MistNovel Terms of Use

Welcome to MistNovel, a storytelling platform operated by AYA Pte. Ltd. ("we," "us," "our"). These Terms of Use (these "Terms") govern your access to and use of MistNovel's website, mobile application, and services (collectively, the "Service"). By using the Service, you agree to these Terms. If you disagree, you must not use the Service.

1. Eligibility & Accounts

1.1 Age requirement. You must be at least 13 years old to use MistNovel. If you are between 13 and 17, you must have parental or guardian consent to use the Service. If we learn you are under 13 and have not obtained consent, we will terminate your account and delete data.
1.2 Gmail / Google sign-in. You may register using a Gmail (Google) account. You must provide accurate, complete information.
1.3 Account security. You are responsible for maintaining your account credentials and keeping them confidential. You also accept responsibility for all activities under your account.
1.4 Account termination. You may delete your account. We reserve the right to suspend or terminate accounts at our discretion (e.g. for violations of these Terms).

2. Zones of Content: Fanfiction & Premium

2.1 Free Zone (Fanfiction / Community).
  • Fanfiction and community works may be posted free of charge, labeled as "noncommercial transformative works."
  • Such content must not be monetized—no paywalls, locked chapters, or premium tiers.
  • We may host site-wide advertising; however, if a rights holder issues a valid takedown request, we will remove the fanwork promptly.
  • Fanfiction content is user-generated and remains the responsibility of the uploader.
2.2 Premium Zone (Original / Licensed Works).
  • Only creators who own or have licensed full rights may publish in the Premium zone.
  • All creators must sign a Creator Agreement (digital contract) specifying distribution rights, revenue share, ownership, payout terms, and anti-plagiarism clauses.
  • Premium works may be monetized via subscription, chapter purchases, or other mechanisms.
  • The service will keep strict separation: fanfiction content may never be part of monetized premium content.

3. User Content & License

3.1 "User Content" defined. Means any stories, characters, comments, reviews, images, text, or other materials you post or upload.
3.2 Your ownership. You retain all rights, title, and interest in your User Content, subject to the licenses you grant below.
3.3 License to MistNovel. By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license (and right to sublicense to our affiliates) to host, store, display, reproduce, transmit, perform, publish, modify (for formatting), and distribute your content within the Service.
3.4 License to other users. By posting User Content, you also grant other users a license (consistent with Service functionality) to view, share, comment, or interact with your content.
3.5 Representations & warranties. You represent and warrant that:
  • You own or have licenses/permissions to all User Content you upload.
  • Your User Content does not infringe third-party rights (copyright, trademark, privacy, publicity).
  • Your User Content does not violate laws, defame, harass, or contain disallowed content (see Section 5).

4. Content Removal & DMCA

4.1 Right to remove. We reserve the right (but not the obligation) to remove, disable access, or delete any User Content that violates these Terms or is deemed objectionable.
4.2 DMCA & copyright infringement claims. We comply with U.S. DMCA Safe Harbor provisions. If you believe your copyright has been infringed, send a notice to: contact@misteria.ai
We will act to remove or disable access to the allegedly infringing content and notify the uploader. The uploader may submit a counter-notice.
4.3 Repeat infringers. We will terminate accounts of repeat infringers (three-strike policy).

5. Prohibited Conduct & Content

You agree not to use the Service in ways that:
  • Upload or publish illegal, pornographic, defamatory, hateful, violent, or harassing content
  • Promote real-person sexual content or exploitative material
  • Violate privacy or personal data rights
  • Violate any law including intellectual property, data protection
  • Use bots, scrapers, crawlers, or automated tools not explicitly permitted
  • Circumvent security or access controls
  • Engage in spam, advertising, or commercial solicitation in free zones
  • Impersonate others or misrepresent your affiliation
We may moderate, filter, or block content at our discretion.

6. Monetization & Payments

6.1 Payment processing. All payments (for premium content, reading tickets, etc.) are processed through third-party payment providers (e.g., Apple Store, Google Pay). We do not store full payment card details.
6.2 Pricing and changes. We may change pricing or structure; users will have notice before changes take effect.
6.3 Refunds. Unless mandated by law, purchases are non-refundable.
6.4 Creator payments. Premium creators are paid per their Creator Agreement. MistNovel deducts platform fees, processing fees, and applicable taxes before distributing their share.

7. Termination & Suspension

  • We may suspend or terminate your access or account at any time for violation of Terms.
  • If you terminate, your User Content may still be retained or archived per our retention policy (see Privacy).
  • Sections that by their nature survive termination (e.g. indemnity, liability disclaimers, licenses, dispute resolution) remain in effect.

8. Disclaimers & Limitation of Liability

8.1 "As is" basis. The Service is provided "as is" and "as available," with all faults. We make no warranties regarding uptime, security, accuracy, or freedom from errors.
8.2 Limitation of damages. We will not be liable for any indirect, incidental, consequential, punitive, or special damages arising from your use of the Service, even if we were aware of the possibility.
8.3 Indemnification. You agree to defend, indemnify, and hold harmless MistNovel, its affiliates, officers, employees, and agents, from all claims and liabilities arising from your use of the Service, your User Content, or your breach of these Terms.

9. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of [choose jurisdiction, e.g. Singapore].
  • You and MistNovel agree to submit to the exclusive jurisdiction of the courts in that jurisdiction.
  • Any disputes arising shall be resolved by litigation or arbitration as agreed.

10. Changes to Terms

We may revise these Terms from time to time. We will post the updated version with a new "Last updated" date, and where required, notify you by email or in-app notice. Continued use after changes constitutes acceptance.

11. Miscellaneous

Severability. If a provision is invalid or unenforceable, the remainder shall remain in effect.
No waiver. Our failure to enforce a right does not waive that right.
Entire agreement. These Terms plus Privacy Policy constitute the full agreement between you and MistNovel regarding the Service.
